This german article by a lawyer https://www.it-recht-kanzlei.de/privacy-shield-ungueltig-handlungsoptionen.html also calls Jetpack explicitly. They do exclude some website operators to this regulation, but it is not safe to depend on that. -And it does not prevent you from lawsuits.
